Confidentiality & data protection

Correspondence is treated as confidential, with the exception of "feedback" on completed commissions, which may be reproduced on this web site, unless specifically prohibited by the client.

Copies of correspondence will be retained by me for accounting purposes, and can be made available on request.

Images produced by me may be displayed on this web site, except where the image is not "family friendly" (since this would violate the ICRA Labeling employed by this web site), or their non-use is specifically requested by the client for other reasons.

Contractual Obligations

In accordance with the UK Consumer Protection (Distance Selling) Regulations 2000, I will summarise your instructions, deadlines (if appropriate), a total cost for the artwork, provide you with a durable copy of this "contract", and allow a seven day "cooling-off" period in which you may change your mind (example contract).

Before I start work on your portrait, I will require a 50% non-refundable payment. This is payment for services, and the contract for services may not be cancelled once work on your portrait has commenced.

When your portrait has been completed, you will be provided with on-line preview scans (example preview page). If you wish to purchase the completed artwork, the balance of the quoted price will become payable. This is payment for goods, and you have the absolute right to reject those goods.

Copyright of Commissioned Works

I legally retain the copyright of any images created. If clients wish to reproduce commissioned portraits, I should be informed at the outset of the enquiry, as the sale or relinquishment of copyright will affect the commission price.

I will assume that any photographs (or artwork) submitted to me by clients are not subject to copyright restrictions.

Returns

I attempt to give clients every opportunity to reject the finished artwork before payment and dispatch, but, if you are not happy with your portrait - in the flesh - let me know within 7 working days (as per the UK Consumer Protection (Distance Selling) Regulations 2000 ).

I will pay for the return of the portrait, and refund the purchase price of the goods on their safe return.

Anti-Spam Policy

I do not broadcast unsolicited E-mail for any purpose, and delete spam, chain, and other junk email without forwarding these to third parties.

Anti-Virus Measures

My PC has Anti-Virus Software, which is correctly installed, configured, activated, and updated with the latest version of virus definitions. If my PC should become infected by any viruses, Trojans, Worms or any other forms of malicious code, I will disconnect my PC from the Internet until the problem is resolved to prevent spreading any viruses to third parties through e-mails, or through any files that I may upload to this web site.

Family Friendly & Child Safe Contents

This site can be safely viewed by any member of the family, and is rated by the Internet Content Rating Association (ICRA) as a 'Family Friendly & Child Safe' web site*. The respective ICRA META Tags are in place on all my pages.

* The requirements of ICRA labeling are very specific. The descriptors relate to the content (in images, portrayals, or descriptors) present on the site to be labeled: there is no vicarious liability. "Nudity" is an intrinsic component of art, and difficult to completely avoid on the Internet, and I believe it is up to each individual to use their own discretion when following links.

Google Advertising Cookie and Privacy Policies

The Double Click DART cookie is used by Google advertisements on this web site. When users either view or click an ad, a cookie may be dropped on that end user's browser. The data gathered from these cookies will be used to help Ad Sense publishers serve and manage the ads on their site(s) and across the web more effectively.
